Coverage Options for Business Owner Policy (BOP)

Property Insurance

This is for buildings and contents owned by the company.

Business Interruption

This covers the loss of income resulting from a fire or other catastrophe that disrupts the operation of the business. It can also include the extra expense of operating out of a temporary location

Liability Protection

This covers your company’s legal responsibility for the harm it may cause to others. This harm is a result of things that you and your employees do or fail to do in your business operations that may cause bodily injury or property damage due to defective products, faulty installations and errors in services provided.

Employment Practices Liability Insurance (EPLI)

Employment practices liability is generally not covered by general liability insurance, but can be purchased as a stand-alone policy or added as an endorsement to a Business Owners Policy or Commercial Package Policy. Bear in mind that EPLI coverage may have more limits and exclusions as part of a package policy. EPLI covers companies against claims or lawsuits filed by employees, former employees and employment candidates regarding their employment relationship with an employer. This type of coverage protects the company, its directors, and officers, as well as current and former employees. EPLI policies may also cover seasonal employees, leased employees and independent contractors.

Coverage Options for Auto

Bodily Injury Liability

If you’re driving a car we insure and are in an accident that causes bodily injury to someone else, this coverage pays the injury damages that are your responsibility.

Property Damage Liability

Like Bodily Injury Liability, but pays for damages to another person’s car or other property.

Underinsured Motorist – Bodily Injury

If another person with little or no insurance causes an injury to you, this coverage steps in and pays the damages owed to you that otherwise aren’t covered. (The amount of coverage you carry can’t exceed your limit of Bodily Injury Liability coverage.)

Underinsured Motorist – Property Damage

This coverage pays for damage to your car or other personal property caused by someone driving without any (or not enough) insurance. A small deductible applies.

Personal Injury Protection

This coverage pays necessary and reasonable medical expenses, income loss, and benefits for extra expenses for you, family members of your household, and guests in your car in case of accidental injury or death. (You must have Liability coverage to purchase this coverage.)

Collision

The policy pays for damage to your car from collision or upset, regardless of fault. You select the appropriate deductible amount.

Comprehensive

Covers damage to your car caused by something other than collision or upset, subject to your deductible. (Examples: theft, accidental glass breakage, fire, vandalism.)

Towing and Labor

Pays for towing when your car won’t operate under its own power. Charges for labor at the site of breakdown are also covered.

Rental Reimbursement

In the event of a covered loss, car rental expense is covered up to the rental reimbursement limits you select.

Auto Loan/Lease Coverage

Applies to a covered total loss. If there’s a traditional loan, it will pay either its principal outstanding balance or the actual cash value of the car at the time of loss, whichever is greater.

If the auto is leased, it will pay the value of the vehicle and any other amount owed to the leasing company.


Things not included in a Business Owner Policy (BOP)

BOPs do NOT cover professional liability, auto insurance, worker’s compensation or health and disability insurance. You’ll need separate insurance policies to cover professional services, vehicles and your employees.

What EPLI covers protection

EPLI provides coverage for legal costs, settlements and judgments that arise from claims of:

  • Discrimination, based on age, race, gender and other factors.
  • Sexual harassment.
  • Wrongful termination—including constructive discharge, in which an employee resigns as a result of the employer creating a hostile work environment; and retaliatory discharge, in which an employee is fired as punishment for engaging in a legally protected activity.
  • Breach of employment contract.
  • Infliction of emotional distress or mental anguish.
  • Failure to employ or promote.
  • Wrongful discipline or demotion.
  • Mismanagement of employee benefits.
  • Defamation.
  • Privacy violations.
  • Violation of the Family Medical Leave Act or other such laws.

Some policies contain a catch-all category to provide coverage for claims of discrimination based on protected categories (e.g., sexual orientation) that are not covered under federal discrimination statutes, but may be covered by state or local law.

EPLI coverage can also protect the business owner from meritless claims brought by disgruntled employees.

What’s Not Covered

While EPLI covers many areas of employment risk, most policies have certain exclusions, such as violations of the National Labor Relations Act, the Worker Adjustment and Retraining Notification Act, Occupational Safety and Health Act (OSHA), and the Employee Retirement Income Security Act (ERISA), as well as claims arising under workers compensation laws. EPLI also will not cover punitive damages or claims resulting from criminal acts. Privacy violations caused by a computer breach also may not be covered by EPLI.
